Terms of Service

Welcome to Tomogether. These Terms of Service ("Terms") govern your access to and use of the Tomogether website, mobile interface, Telegram bot, and any related services (collectively, the "Service"). By creating an account or using the Service you agree to these Terms.

1. Who we are

The Service is operated by Sole Proprietor Baluev Dmitrii (in Armenian official records: Private Entrepreneur «ԱՁ»), an individual entrepreneur registered in the Republic of Armenia on May 7, 2026 (HVHH / tax identification number 20286781, public registry number 286.1580941). Registered office: 27 N. Tigranyan Street, Yerevan, Armenia. In these Terms we refer to ourselves as "we", "us", or "Tomogether".

2. The Service

Tomogether is an entertainment service that lets you interact with AI-driven characters ("Companions") through web and messaging platforms. Companions are software constructs powered by large language models and other AI systems; they are not real people and any apparent biography, schedule, personality, or memory is generated content.

The Service currently delivers conversations through Telegram and the Tomogether web interface. We may extend delivery to additional messaging platforms (such as WhatsApp, Discord, Instagram direct messages, or other comparable services) over time. When you connect such a platform, messages flow through that platform's infrastructure subject to its own terms, in addition to these Terms.

We may update, improve, suspend, or discontinue features of the Service at any time. We will use reasonable efforts to notify users of material changes.

3. Eligibility and accounts

  • You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use the Service.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You agree to provide accurate information when registering and to keep it up to date.
  • Each person may only operate one personal account unless we expressly permit otherwise.

4. Acceptable use

You agree not to:

  • Use the Service to harass, threaten, defame, or harm any real person.
  • Attempt to extract personal data about other users.
  • Create or attempt to create Companions that impersonate, or are substantially similar in appearance, voice, or identity, to real, identifiable persons (including celebrities, public figures, and private individuals) without their explicit consent.
  • Upload images, voice samples, or other personal materials of any real person without their explicit consent. You may upload images of yourself only if you can verify your own identity.
  • Reverse engineer, decompile, or scrape the Service, except to the extent permitted by mandatory law.
  • Use automated tools, bots, or any means to generate artificial traffic, abuse rate limits, or evade access controls.
  • Attempt to circumvent content safety mechanisms, including by prompting Companions to produce content that violates these Terms.
  • Use the Service in connection with any unlawful, fraudulent, or infringing activity, or in violation of export-control or sanctions laws.
  • Upload content that you do not have the right to share, or that contains malware.

We may suspend or terminate accounts that violate these rules.

5. Content generated through the Service

Conversations, images, voice messages, and other content produced by Companions are generated by AI systems. They may contain inaccuracies, fictional claims, or unexpected output. The Service is provided for entertainment and companionship and is not a substitute for professional advice (medical, legal, financial, psychological, or otherwise).

You retain ownership of the text, images, or other content you submit. By submitting content you grant us a worldwide, non-exclusive, royalty-free license to host, process, and display that content as needed to operate the Service, including passing it to third-party AI providers that generate Companion responses.

User-created Companions. The Service may allow you to create your own Companion in exchange for in-app currency. User-created Companions are private to your account by default and are not shared with other users or published publicly. We may scan inputs you provide (such as descriptions, reference images, voice samples) for compliance with these Terms and content-safety policies, and may refuse or remove a user-created Companion that violates Section 4 (Acceptable use), Section 8 (Intellectual property), or applicable law.

6. Subscriptions, virtual currencies, and purchases

  • Subscriptions grant access to additional features (such as higher daily limits and real-time media) for the period you have paid for. They renew automatically unless cancelled before the next renewal date.
  • Tomotokens are an in-app virtual currency you earn through activity. They can be spent on in-app items (gifts, wardrobe items, boosts, custom Companions) and have no monetary value outside the Service. They cannot be exchanged for cash, refunded, or transferred between accounts.
  • Tomogems are a premium virtual currency that may be purchased for real money and spent on in-app items and limit top-ups. Once credited to your account, Tomogems are consumed digital goods and are non-refundable except as described in our Refund Policy.
  • Prices and limits are shown at the point of purchase and may change with notice.

7. Third-party services

The Service relies on third-party providers (including but not limited to AI model providers, image-generation services, text-to-speech services, payment processors, and messaging platforms such as Telegram). Your content may be processed by these providers strictly as needed to deliver Companion responses and platform functionality. See our Privacy Policyfor details.

8. Intellectual property

All rights in the Service, including the Tomogether brand, software, character catalog, scripts, prompts, and curated content, are owned by us or our licensors. Nothing in these Terms grants you any right to use our trademarks or branded material outside the Service.

9. Termination

You may request deletion of your account at any time by writing to [email protected]: access closes right away, and your data is kept for 30 days in case you change your mind, then erased. We may suspend or terminate access to the Service if you breach these Terms, if continued provision becomes unlawful, or if we decide to discontinue the Service. On termination, your right to use the Service ends; provisions that by their nature should survive (such as ownership, disclaimers, limitation of liability, and dispute resolution) will survive.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated output will meet your expectations.

11. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) one hundred US dollars (USD 100). In no event will we be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law (including consumer-protection laws).

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced at least 30 days in advance through the Service or by email. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Armenia, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be brought before the competent courts of the Republic of Armenia, unless mandatory consumer-protection law in your country of residence requires otherwise.
